PackD — Terms of Service

These Terms of Service ("Terms") govern access to and use of PackD, provided by DNZ Labs Xolo Go OÜ, Paju tn 1a, 50603, Tartu Maakond, Estonia (VAT EE102156920) ("PackD," "we," "us"). By accessing app.packd.pro or using the PackD service, your organization ("Client," "you") agrees to these Terms.
1. The service
PackD is a business-to-business SaaS platform that helps packaging design teams and agencies verify packaging artwork against regulatory requirements (using citations from our sister regulatory database, Seshat), brand guidelines, and material specifications, and manage the resulting approval and sharing workflow.
2. Eligibility
PackD is intended solely for use by businesses and professionals acting in a business capacity. It's not directed at, and may not be used by, individual consumers or anyone under 18 years of age.
3. Accounts and access
Tenant accounts are created by PackD's administrators upon agreement with your organization — there's no self-service signup. Once your Tenant is set up, your organization's designated Admin(s) may invite additional users, and may optionally configure granular custom Roles to control what specific users or teams within your organization can do. You're responsible for the activity that occurs under your organization's account, and for keeping login credentials confidential.
4. Acceptable use
You agree not to use PackD to: upload content you don't have the right to upload; attempt to access another Tenant's data; interfere with or disrupt the service; or use the service for any unlawful purpose.
5. Your content
You retain full ownership of any artwork, documents, or other content you upload to PackD ("Client Content"). You grant PackD a limited license to store, process, and analyze Client Content solely to provide the service to you. We don't claim any ownership over Client Content, and we don't use it to train models for any purpose beyond delivering the service, unless we've separately agreed otherwise with you in writing.
You're responsible for having the right to store and process, within PackD, any information you record about third parties (for example, contacts at your own clients, suppliers, or partners, or recipients of an externally shared report), and for giving those individuals any notice required under applicable data protection law.
6. Sharing externally
PackD lets your organization generate external, no-login links to share a compliance report with people outside your organization (for example, a brand owner or client). You're responsible for choosing appropriate recipients and settings (password, expiration, comments, download) for any link you create, and for revoking a link when it's no longer needed. PackD isn't responsible for who a recipient forwards an unprotected link to.
7. Compliance verification — important disclaimer
PackD is a verification aid, not a substitute for legal or regulatory advice, and does not guarantee regulatory compliance. Findings generated by PackD are based on the regulatory content currently indexed in our regulatory database (Seshat) and on automated analysis of your artwork — both of which have real, documented limitations. For example, a "Compliant" result on a given check reflects that no issue was found against currently indexed content, not an independent legal certification that the artwork fully complies with all applicable law; where PackD can't verify something (e.g. no regulatory content indexed yet for a segment), it says so explicitly rather than guessing, and that should be treated the same as "not verified," never as a green light. Final responsibility for the regulatory and legal compliance of your packaging remains with your organization. We recommend qualified legal or regulatory review for any artwork before it goes to print, particularly where the stakes of non-compliance are high.
8. Fees and payment
Fees, billing cycle, and payment terms are agreed individually with each Tenant and aren't processed through this website. Details are set out in your organization's individual agreement with PackD.
9. Term and termination
These Terms remain in effect for as long as your organization has an active PackD account. Either party may terminate the arrangement as set out in your organization's individual agreement with PackD. Upon termination, your data is retained and then deleted per our Privacy Policy's data retention terms.
10. Data protection
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
11. Disclaimers and limitation of liability
The service is provided "as is." To the fullest extent permitted by law, PackD disclaims all warranties, express or implied, and PackD's total liability arising from your use of the service is limited to the fees paid by your organization in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Governing law
These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts of Estonia, unless mandatory consumer or local law provides otherwise.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above.
